MPs Approve the Nomination Kindiki as the Deputy President—Court Issues A Stay Order

Earlier today, in the midst of the ongoing special meeting at the national assembly, the Speaker of the House was notified of the nomination of Prof. Kithure Kindiki by the President for the position of Deputy of President of the Republic of Kenya following the ouster of Rigathi Gachagua.

The House Business committee convened an emergency meeting to asses and determine the next move alongside the ongoing proceedeings chairded by the deputy speaker, Gladys Sholei.

Upon consideration and determination, members agreed to proceed with the voting process with the aim of surpassing the preliminary court injucntion should the DP’s legal tam head to the court. 

However, the high court has issued a conservatory order halting the implementation of the Senate resolution, which upheld the impeachement of the deputy president, and the nomination of the new deputy president. 

Justice Mwita of the High Court issued a staying order stopping the implementation go-ahead until October, 24th—-awaiting the appointment of a bench of judge by the Chief Justice of the Supreme Court, Martha Koome.

“THAT in the meantime, due to the issues raised in the petition and applications and the urgency demonstrated, a conservatory order is hereby issued, staying implementation of the resolution by the Senate upholding the impeachment charges against the petitioner, the Deputy President of Kenya, including the appointment of his replacement until 24th October 2024 when the matter will be mentioned before the bench to be appointed by the Chief Justice for appropriate orders and actions,” Justice Chacha Mwita.

Yesterday Senators approved 5 of 11 charges implicating Rigathi Gachagua setting the stage for being the fira to have been impeached through a constitutional process. Gachgua who fell sick from chest pains could not attend the second session, which he was to appear as witness is still recieving treatment at the Karen hospital.

A total of 236 members of the National Assembly, in rushed process, voted today during the parliamentary plenary meeting to approve the nomination of Prof. Kithure Kindiki—appointed hours after the impeachment of Gachagua was upheld by the Senate.
