The Acting Inspector, Gilbert Masengeli General of Police has been handed six months imprisonment after he was found guilty of contempt of court.
Masengeli snubbed the court order seven times in a case he was required to answer to the whereabouts of the trio suspected to have been abducted by the police officers.
He, however, said through his lawyers that his subsequent absence to appear before the court was necessitated by the visit to the North Eastern counties, where he went to carry out security checks.
Justice Lawrence Mugambi ordered him to submit himself to the commissioner general prisons, failure to which the CS for Interior must take actions to ensure he serves the sentence.
“Masengeli is ordered to commit himself to the commissioner general of prisons to ensure that he is committed to a prison facility to commence serving his sentence of imprisonment,” Justice Mugambi ruled.
“In the event that he does not submit himself to the commissioner general of prisons, the cabinet secretary for interior must make sure that all steps that are necessary and permissible in law are taken to ensure that Msengeli is committed to prison to commence serving the sentence imposed on him,” he added.
Masengeli, however, has given another window to appear before court in the next seven days to avoid serving the sentence.
“Masengeli can redeem himself by availing himself before this court in person to answer to the issues on which he has been avoiding; failure to do so, the sentence will become effect,” Justice Mugambi said.
The three went missing on August 19 in Mlolongo and Kitengeal areas in a suspected abduction and crackdown over the Gen Z demonstrations.
The Acting IG instead sent the DIG Kenya Police Service Eliud Lagat on Monday to represent him, saying he was committed on security matters in the North Eastern counties.
